Please read these Terms & Conditions carefully before ordering any Products from the Site. You should understand that by ordering any of our Products, you agree to be bound by these Terms & Conditions. 1 Information about us

The Site is operated and wholly owned by Upin Global Trading PLT.

2 Definition

In these Terms and Conditions the following expressions shall have the following meanings:

  • “Account” means the User Account that you would need to register on the Site before any order.
  • “Business Day” will be the Malaysia working days in both Johor and Selangor State. Please note that Friday and Saturday are not Business Days in Johor.
  • “Customer” or “Customers” or “you” or “your” shall mean you and all other persons who places an Order to purchase the Products on this website under your Login.
  • “Order” or “Orders” shall mean the order(s) submitted by you to purchase the Product from the Site under your Login.
  • “Product” or “Products” shall mean any and all the products offered for sale by Upin Global Trading PLT.
  • “Site” means www.upin-global.com.
  • “Terms and Conditions” shall mean the terms and conditions contained herein including any modifications and amendments or additions thereto from time to time.
  • “We” or “Us” or “Our” or “Upin Global” shall mean Upin Global Trading PLT.

3 Registration

Customer must register with Us by creating an Account on the Site before any order. Customer shall agree to complete the registration process according to the requirements as stated on the Site. The Customer shall provide Upin Global with complete and updated information which shall include (but shall not be limited to) the Customer’s legal name, address, telephone or mobile phone numbers and e-mail address. If the Customer provides any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), Upin Global has the absolute right to suspend or terminate the registration of such Customer and/or refuse any and all its current or future use of this site. Once the Customer has completed and submitted its registration, We shall deem that the Customer has opted in to receive email communication and from us.

4 Formation of A Contract

  1. You may place an order to purchase a Product advertised for sale on the Site. You will have an opportunity to check and correct any input errors in your order up until the point at which you submit your order by clicking the “Proceed to Payment” button on the “Payment details” page. No amends can be made by you to your order after this point.
  2. After placing an order, you will receive an e-mail from us acknowledging that we have received your order and giving you an order number and a summary of your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (the Dispatch Confirmation). The contract between us for the sale of a Product will only be formed when we send you the Dispatch Confirmation for the relevant Product. If you order several Products from us which are being delivered at different times or separately from different warehouse, each contract is formed when we provide the Dispatch Confirmation for each Product.
  3. Each Contract will relate only to those Products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation.
  4. We may, in our sole discretion, refuse or cancel any order and limit order quantity. We may choose not to accept your order for any reason and we will not be liable to you or to anyone else in those circumstances.
  5. We may be unable to process your order if:
    • the Product you ordered is out of stock or discontinued; or
    • there is a problem with authorization of your method of payment.

5 Delivery

  1. We shall deliver the Products to the delivery address specified and keyed in by you on the order form. Your order will be delivered to you via the service of a courier service company appointed by us, with a traceable service.
  2. We do everything in its power to respect the delivery times indicated on the Website. However, delivery duration is solely depending on the courier company which is out of Our control. We shall not be held responsible for the consequences of a late delivery or the loss of a package caused by a third-party contracted to make delivery, or because of some unforeseen event or an Act of God. Customer shall contact the Courier Company directly if there is any doubt on the delivery.
  3. Shipping is only available during Business Day.
  4. If delivery or collection is delayed through your unreasonable refusal to accept delivery or if you do not accept delivery or collect the Product from the carrier, then we may (without affecting any other right or remedy available to us) do either or both of the following:
  5. We may be unable to process your order if:
    • charge you for our reasonable costs incurred by Us; or
    • no longer make the Product available for delivery or collection and notify you that we are immediately cancelling the order, in which case we will refund to you or your credit card company as applicable any money already paid to us under the order, less our reasonable administration charges (including for attempting to deliver and then returning the Product, and any others as provided).
  6. Shipping fee is excluded from earning Member Points.

6 Price

Price of the Products shall be as quoted on the Site at the time Customer place an order. These prices may include applicable local taxes and other applicable charges, but exclude delivery costs. The delivery costs are clearly shown during the ordering process and in addition to the price of the products. We reserve the right to modify our prices at any time but this will be indicated to you on the order at the time the order is placed.

7 Payment

  1. We cannot complete your order until you have paid for it in full. Payment can be made by most debit or credit cards and other payment methods acceptable to us, by completing the relevant details on the “Payment” page. We shall not be liable for any credit card or other payment fraud. Please take note that additional charges may be incurred if you are using a non-Malaysian issues card due to Foreign Exchange, depending on your card issuer.
  2. All product prices listed are in Ringgit Malaysia (RM).
  3. Full payment in respect of an order must be made upon the placing of the order. If your payment cannot be processed, the order will be not be accepted and you are advised to contact your card issuer to resolve any problem concerning the use of your credit card in order to continue with the order.
  4. If an obviously incorrect price appears on our website and is not corrected on your total at the time of order completion, for whatever reason (human error, technical error etc.), your order will be cancelled and the payment refunded to you, even if it has been initially validated.
  5. If payment to an Order has already been made but the Order is rejected by Us, you will be entitled for your refund but the receipt of the refund will depend on the period of time your financial institution takes to finalize the refund. We shall not be liable with respect to any loss, damage, cost, or expense that you or any person may incur as a result of any delay in your financial institution processing the said refund.

8 Returns, Refunds and Exchange Policy

  1. You shall examine the Products immediately upon delivery for any deficiencies and/or damages. Claims must be lodged to our customer service within three (3) days after the time of delivery; otherwise we shall have the discretion to refuse your claim. Customer service can be reached via details in “Contact Us”.
  2. Exchange of the product or refund for the product can be arranged for the following reasons:
    • If the product is obviously damaged at time of delivery.
    • If the product is damaged inside packaging after delivery.
    • If the product ordered is different from the item delivered.
  3. The Customer shall be responsible for the risks and condition of the Product to be returned until it delivered to Us. We will not be liable for any loss or damage to the Product prior to the Product is received by us. All items must be received by Us before we proceed to refund or exchange.
  4. Products returned for a refund shall be refunded at the price which you had paid at the point of ordering. Products to be returned must be returned in its original packaging, unused, with all gift items (if any) together. You shall ensure that the Product is sent to us in the same condition as it was when received by you and is packaged properly to prevent any loss or damage to the Product or its box or its original packaging. In the event that an item is returned to us in an unsuitable condition, we reserve the right not to accept returns and send the Product back to you.
  5. Any return, exchange or refund due to buyer convenience are not acceptable to us. Please make sure your order is correct before checkout. 
  6. All member points awarded for the order of the refund product(s) will be removed from member account

9 Liability

  1. We are not responsible for, and cannot guarantee the performance of, goods and services listed in Our Site which are manufactured by third parties. While we will use reasonable endeavours to provide accurate information, product packaging and material may contain more and/or different information. Always read labels, warnings, directions, and other information provided with the product before using any product. For additional information about a product, please contact the manufacturer. If you find a Product is not as described, your sole remedy is to return it in an unused condition (excluding products that are not eligible for return), in accordance with our return policy. 
  2. The Customer shall ensure that the Products are not used for any purpose for which they are not suitable and shall be responsible for using all necessary skill and care in handling and using the Products. The Customer expressly acknowledges and agrees that We assumes no obligation or liability for any advice or information given with the Products and Guardian shall not be responsible for any inaccuracy or misstatement of any such information. The Products shall be accepted by the Customer entirely at the Customer’s risk.
  3. Our total liability in connection with these terms and conditions and any resulting sale or provision of products, arising from any cause, is limited to the price paid for the Product(s) giving rise to the claim.  We accept no liability for special, indirect, incidental, punitive, and/or consequential damages of any nature, any loss which is not reasonably foreseeable or for any business loss

11 Feedback and Comments

Any opinions left on the Website by Our customers are screened and moderated by Us. If the comments infringe on the law or are inappropriate (abusive publicity, defamation, insults, out of context commentary…), We reserves the right to refuse, modify or delete it.
